These are the official rules (the "Official Rules"), for The Jacked™ March for Mad Cash $100,000 Sweepstakes (the "Game"). The Game is administered by Liquid Graphics Inc ("Administrator”, “Judges” “Commissioners”), located at 901 Santa Fe Drive, Denver, CO 80204 and is sponsored by Jacked ("Sponsor"), located at 3143 Donald Douglas Loop South, Santa Monica, CA 90405.
NO PURCHASE REQUIRED TO PLAY OR WIN. Open to legal residents of the 50 United States and Washington D.C. (EXCLUDING SUCH RESIDENTS IF LOCATED IN OVERSEAS MILITARY INSTALLATIONS, PUERTO RICO, OTHER U.S. TERRITORIES OR FOREIGN TERRITORIES) who are 18 years of age or older at time of registration (an "Entrant", "You" or "Your"). Game void where prohibited by law or regulation. Game subject to federal, state and local laws and regulations. Only one entry per person / e-mail address.
THE OBJECTIVE OF THIS GAME IS SIMPLE. SELECT AS MANY CORRECT GAMES AS YOU CAN TO WIN UP TO $100,000 (there will not be any ties).
REGISTRATION FOR The Jacked™ March for Mad Cash $100,000 Sweepstakes: Registration and Game Play is Free. Obtain a player's user name by completing the official online registration form at www.marchformadcashsweeps.com. By participating, you agree to these Sponsor's "Official Rules" and to the decisions of the Administrator (the “Judges” and or “Commissioner”), which are final and legally binding in all Promotion related matters. In order to play, you must have access to the World Wide Web. For promotion/game start dates and times see “GAME BEGINS” section below.
PROMOTION/GAME BEGINS: Sunday, March 16, 2008 at 8:01 P.M. EDT and ends at 12:01 A.M. (PST) on March 20, 2008. Administrators’ computer server will be the sole timekeeper for this promotion. Once you submit your bracket, it is final and cannot be changed.
TOURNAMENT GAME DAYS: Participants will have access to the promotional game site ONLY to view their selections and to keep up with the official ‘in progress bracket’. Should the tournament be canceled, this promotion will be cancelled.
PRIZE LEVELS: There will only be up to one winner per each prize level, there will not be any ties. A random draw will occur if there are multiple entrants who guessed the required number of game winners per prize level.
A – Correctly guess Sixty (60) or more game winners to win $100,000.00
B – Correctly guess Fifty-Seven (57) to Fifty-Nine (59) game winners to win $20,000.00
C – Correctly guess Fifty-Five (55) to Fifty-Six (56) game winners to win $1,000.00
AWARDING OF THE SWEEPSTAKES PRIZE:
At the conclusion of the Tournament in San Antonio, the Administrators will review all entries to determine if any valid entrant has the correct number of game winners within their submitted bracket to be eligible for the prize levels noted above. A valid entry is defined as; entrant has registered and selected their tournament picks as of 12:01 A.M. (PST) on March 20, 2008. After review and sorting of the entries, if there is more than one entrant who correctly guessed the required number of game winners per each prize level as determined by the Judges (pending verification), a random draw of those entries will occur to award the amount noted in that prize level. It is possible that there will only be one winner per each prize level where there will be no need for a random drawing.
SWEEPSTAKES PRIZE(S):
Prize payable to the winner by company check. If any of the prizes are not won per the Official Rules, the prizes will become null and void and will not be awarded. Total value of all prizes $121,000.
PROMOTION/GAME PRIZE NOTES: Taxes on Prize are solely the responsibility of each winner. Prize is non-transferable.
ELIGIBILITY: Officers, directors, representatives, employees, of Sponsor, Administrator, and their respective parent, affiliate and subsidiary companies, their advertising/promotional agencies, and the members of their immediate families or those persons living in the same household of anyone so employed are ineligible to enter or win. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year during the twelve months preceding the start of the Promotional Period.
GENERAL RULES: No substitution or transfer of prize by winner permitted. Administrator/Sponsor and their agencies are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone, computer hardware, software and other technical failures of any kind, including injury or damage to any person's computer relating to or resulting from participating in or experiencing any materials in connection with the game promotion, unauthorized human intervention, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause that may limit a user's ability to participate in the game promotion. Sponsor/Administrator reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these official rules. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. Sponsor/Administrator assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or email client or for insufficient space in user's e-mail account to receive e-mail. Sponsor/Administrator reserves the right to cancel or modify the game promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by Sponsor/Administrator, in their sole discretion. In the event of termination of the game promotion, a notice will be posted online and no prize will be awarded. Proof of submitting entries will not be deemed to be proof of receipt by Administrator. Any use of robotic; automatic, programmed or like entry methods will void all entries affected by such methods and be deemed tampering. Not responsible for lost, late, delayed, incomplete, illegible, misdirected entries, entries not received by entry deadline, or for electronic, network or computer failures or malfunctions or other technical errors of any kind. All materials submitted become the property of the Sponsor and will not be returned or acknowledged. All game play is subject to review and verification by Administrator, an independent judging organization whose decisions are final and legally binding in all game-related matters. Antifraud detection devices will be used. Sponsor may prohibit any entrant from participating in this game promotion or any future promotion at the sole discretion of Sponsor, such entrant (i) has tampered with the entry process or the operation of the game promotion or Website, (ii) repeatedly shows a disregard for the rules, or (iii) acts (a) in an unsportsmanlike manner, (iiii) with an intent to annoy, abuse, threaten, or harass Sponsor or any other entrant, or (iv) in any other disruptive manner.
NOTIFICATION: Potential Prize winner will be required to sign and return an Affidavit of Compliance & Release form within 10 days of notification. A tax request form W-9 will be requested and a 1099 form will be issued to all major prize winner(s). Noncompliance with these "Official Rules," or, if a selected potential winner cannot be contacted, provides incorrect e-mail or mailing address, is ineligible, fails to claim a prize or fails to return the completed and executed Affidavits and Releases, as required or the prize is returned as undeliverable, NO alternate winner will be selected. If any winner is under the age of 21, a Parent of Legal Guardian will be required to sign the Liability/Publicity Release Form within ten (10) days of notification.
RELEASE, PUBLICITY: By participating, an Entrant agrees to release and hold Sponsor, and/ Administrator, and their respective parent, affiliate and subsidiary companies, their advertising/promotional agencies, and the employees, officers, directors and agents of any of the above organizations from any and all liability for any injuries, losses, or damages of any kind caused by participation in the game promotion or the acceptance, possession or use/misuse of a prize or participation in any prize-related activities or any travel related thereto. By entering this game promotion, each entrant agrees to Jacked.com’s use of his or her personal information as described in the website’s Privacy Policy and authorizes Sponsor and their contractors to list your name and state on the game web site winners list, pending verification, should your score qualify for a game prize. By accepting any prize, winner grants permission to use his/her name, address, likeness, photograph, voice, and statements by Administrator, Sponsor, and their respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies for advertising/publicity purposes, in any media worldwide, in perpetuity, without further compensation, unless prohibited by law. In the event of any discrepancy, these Official Rules shall control and govern.
DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this game promotion, or any prizes awarded, other than the administration of the game promotion or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the state of California in the U.S.; (ii) any and all claims, judgments and awards shall be limited to actual prize in dispute but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses of the prize in dispute, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the game promotion, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A.
